The Netherlands strictly adheres to the OECD Transfer Pricing Guidelines, which are incorporated into Dutch tax law, particularly Article 8b of the Corporate Income Tax Act. Dutch multinational enterprises (MNEs) are required to maintain comprehensive transfer pricing documentation, including a Master File and Local File, in line with BEPS Action 13. While there is no specific financial threshold for documentation, the Dutch tax authorities (Belastingdienst) can request documentation at any time, and non-compliance can lead to significant penalties. Country-by-Country Reporting (CbCR) is mandatory for MNEs with consolidated group revenues exceeding €750 million.
